Terms & Conditions
1. Engagement & Scope
By engaging Thinkcone Technologies for custom software development, website design, mobile application development, digital marketing, or SaaS subscriptions (including Thinkcone CRM), you agree to these Terms and Conditions. Specific project timelines, payment milestones, and feature scopes are detailed in individual service agreements.
2. Intellectual Property & Code Ownership
Upon receipt of full settlement of contracted fees, bespoke source code and customized deliverables created specifically for the client are assigned to the client, subject to the terms of the signed contract. Thinkcone retains ownership of proprietary libraries, pre-existing frameworks, and multi-tenant SaaS infrastructure.
3. Subscription Services & CRM Access
Thinkcone CRM is offered under promotional starter setup terms (Rs. 5,555 including 6 months free access), followed by ongoing monthly or yearly subscriptions. Thinkcone reserves the right to suspend accounts with delinquent subscription renewals after providing advance written notice.
4. Limitation of Liability
Thinkcone provides software and digital services on a professional best-effort basis. We are not liable for business interruptions caused by third-party hosting outages, upstream payment gateway downtime (eSewa, Khalti), or unforeseen force majeure events.
5. Governing Law
These terms are governed by and construed in accordance with the prevailing laws of Nepal. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of the Kathmandu Valley.
